摘　要：

基于法哲学视野，中国特色社会主义政治发展道路与中国特色社会主义法治 道路具有高度的统一性。这种统一性集中体现在合法性基础、内在规定性、制度理性等三个基本方面，其合法性根植于历史、法理、绩效和民意之中。其中，历史合法性从“四个走出来” 获得明证，法理合法性由“三个具备”得以证成，绩效合法性据“四大奇迹”得到展述，民意合法性藉“三个特性”予以诠释。中国特色社会主义政治发展道路的内在规定性蕴藉于本体、本质、逻辑和价值之中，其中，本体的内在规定性昭示于“三者有机统一”，本质的内在规定性显示为“全过程人民民主”，逻辑的内在规定性展现为相互印证的“三大逻辑”，价值的内在规定性展示为“政治文明新形态”。中国特色社会主义政治发展道路的制度理性融科技理性、人文理性和法治理性于一体，其中，科技理性凝练为“三个体现”，人文理性氤氲着“三重眷顾”，法治理性功耕于“三个筑牢”。

 

Legal and Philosophical Interpretation of the Political Development Path of Socialism with Chinese Characteristics

Abstract From the perspective of legal philosophy, the political development path of socialism with Chinese characteristics and the socialist rule of law path with Chinese characteristics are highly unified. This unity is embodied in three basic aspects, namely legitimacy basis, internal regulation and institutional rationality. Its legitimacy is rooted in history, jurisprudence, performance and public opinion. Among them, historical legitimacy has been clearly proved from the "four", legal legitimacy is proved by the "three", performance legitimacy is demonstrated according to the "four miracles" and legitimacy of public opinion has "three characteristics". The internal regulation of political development path of socialism with Chinese characteristics has inherent provisions in terms of ontology, essence, logic and value. The internal stipulation of ontology lies in "three organic unity", the intrinsic stipulation of nature shows "the whole process of people's democracy", the internal stipulation of logic displays mutual confirmation of "three logic" and the intrinsic stipulation of value demonstrates a "new form of political civilization". Institutional rationality of the political development path of socialism with Chinese characteristics incorporates scientific and technological rationality, humanistic rationality and the rule of law rationality, among which scientific and technological rationality is condensed in‐ to "three manifestations", humanistic rationality is dense with "three care" and the rule of law rationality is deeply cultivated in the "three strengthening".
