摘　要：

加快发展新质生产力是全面贯彻落实新发展理念、实现高质量发展、推进中国式现代化的必由之路。发展新质生产力的关键在于生产要素创新性配置。在推进生产要素创新性配置中必须充分发挥法治的协调、保障与促进功能，紧紧抓住交易机制、规制面向、培育环境三大环节，立足中国国情，以整体主义和功能主义为视角，着力打通堵点卡点，创新生产要素配置方式，扫除制约生产要素有效流动的机制障碍，提升生产要素配置效率，营造公开、透明、有序的生产要素配置环境，推动先进优质生产要素向发展新质生产力顺畅流动。就法治的协调功能而言，亟须完善生产要素交易机制，充分发挥市场在生产要素配置中的决定性作用，提升生产要素配置效率；就法治的保障功能而言，要充分重视政府对生产要素创新性配置的规制作用，对市场竞争与要素价格进行有效规制；就法治的促进功能而言，要着力优化促进生产要素创新性配置的社会环境，为生产要素配置的创新提供长远动力。

 

The Intrinsic Mechanism and Legal Approach To The Innovative Allocation of Production Factors

Abstract Accelerating the development of new quality productive forces is essential for fully implementing the new development philosophy, achieving high-quality growth, and advancing Chinese modernization. The key to developing new quality productive forces lies in the innovative allocation of production factors, which necessitates the coordination, safeguarding, and promotion functions of the rule of law. This also requires a focused approach to the three key aspects of transaction mechanisms, regulatory orientations, and nurturing environments. Taking full account of China's national conditions and adopting a holistic and functionalist perspective, efforts should be focused on overcoming obstacles and bottlenecks, innovating the allocation method of production factors, and removing institutional barriers that hinder the effective flow of production factors. This will enhance allocation efficiency, foster an open, transparent, and orderly allocation environment, and facilitate the smooth flow of advanced, high-quality production factors toward the development of new quality productive forces. In terms of the coordination function, it is necessary to improve the transaction mechanisms for production factors, give full play to the decisive role of the market in the allocation of production factors, and enhance the allocation efficiency. In terms of the safeguarding function, it is essential to emphasize the government's regulatory role in the innovative allocation of production factors, and effectively regulate market competition and factor prices. In terms of the promotion function, efforts should be made to optimize the social environment that promotes the innovative allocation of production factors, so as to provide impetus for long-term innovation in the allocation of production factors.
